A customer, fitness enthusiast or sports enthusiast of the Platform is hereinafter referred to as a "User," or collectively, the "Users." Personal Trainers, Fitness studios, gyms, faciilities, or a company offering a adventure experience, fitness professionals, (fitness freelancers), fitness organizations, sports events, the fitnessity ecommerce store, jobs board, is hereinafter referred to as a "Service," or collectively, the "Services"

The Platform may contain links to other websites or resources over which Fitnessity does not have any control. Such links do not constitute an endorsement by Fitnessity of those external websites. You acknowledge that Fitnessity is providing these links to you only as a convenience, and further agree that Fitnessity is not responsible for the content of such external websites or the protection and privacy of information you provide while visiting such external websites.
PERSONAL INFORMATION RECEIVED BY YOU
Fitnessity collects personal information only if you voluntarily choose to share such information with Fitnessity. You may browse the Site without disclosing any personal information. However, in order for you to take advantage of particular opportunities provided through the Platform, we may require that you furnish personal information.
When you register your account; when you sign up for newsletters, complete forms for optional programs, surveys, polls, contests, sweepstakes and promotions; When you make a purchase, when you submit a quote, when you hire a service, when you communicate with our service providers, when you interact with our blogs and forums. Also through communications transmitted through Fitnessity either with us or with other users through the platform. Also through applications and your use of the Fitnessity mobile application. You also may choose to send Fitnessity personally identifying information in an email message containing information or inquiries about the Platform.
The information you provide directly to us may concern you or others and may include, but is not limited to: (a) name; (b) zip code; (c) email address; (d) home or business telephone number; (e) home, business or mailing address; (f) demographic information (e.g., gender, age, political preference, education, race or ethnic origin, and other information relevant to user surveys and/or offers); (g) date of birth; (h) insurance information; (i) photographs; (j) information about your project, request or need; (k) video or audio files; and/or (l) in certain circumstances, payment and/or identity verification information. It may also include information specific to services you are requesting or offering through the Platform, such as a business name, service description, qualifications and credentials. You are not required to provide us with such information, but certain features of the Platform may not be accessible or available, absent the provision of the requested information.
Social Media Data Collection
We may collect information about you or others through Fitnessity affiliates or through non-affiliated third parties. For example, you may be able to access the Platform through a social networking account, such as Facebook or Linked In. If you access the Platform through your social networking account, you may allow us to have access to certain information in your social networking profile. This may include your name, profile picture, gender, networks, user IDs, list of friends, location, date of birth, email address, photos, videos, people you follow and/or who follow you, and/or your posts or "likes."
Social networking sites, such as Facebook and Linked In, have their own policies for handling your information. For a description of how these sites may use and disclose your information including any information you make public, please consult the sites' privacy policies. We have no control over how any third-party site uses or discloses the personal information it collects about you.

Fitnessity collects and stores certain data about the use of the Platform on an aggregate and/or anonymous basis. Fitnessity does not link this information to anything personally identifiable to you.
COOKIES AND OTHER TECHNOLOGIES
Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. We require that cookies be enabled for you to take advantage of the services we offer on Fitnessity.
FITNESSITY’S USE OF PERSONAL INFORMATION
Fitnessity uses Personal Information for the following general purposes:
- To provide our products and the Service.
- To enable you to use the services available through the Platform, including registering you for our services and verifying your identity and authority to use our services.
- For billing, identification and authentication, and fraud prevention.
- To analyze Platform usage and improve our products and the Services.
- To contact you and deliver administrative notices and communications relevant to your use of our products and services. To periodically send promotional emails regarding new products from Fitnessity, special offers from Fitnessity, or other information that may interest you
- To improve and maintain the Platform and for product development

- To resolve disputes, to protect ourselves and other users of the Platform, and to enforce any legal terms that govern your use of the Platform.

Although we ensure that our third party agents (“Agents”) receiving your information are bound by privacy restrictions at least as restrictive as those set forth in this policy, Fitnessity is not responsible for any issues that may arise regarding the Privacy Policies of any of its affiliates or advertiser. By using this website, you do hereby agree to hold Fitnessity harmless from any claims and/or damages that may arise from the actions of any of its affiliates and/or advertisers.
Two things drive Fitnessity decisions regarding the use of information collected from Users: 1) improving user experience by offering personalized services, content and advertising, and 2) market research.
In addition to banner ads, Fitnessity may advertise products, companies and events that we think might interest you through the email address you provide.
Fitnessity may analyze Personal Information and Web Navigational Data based on your interests and may use the analysis from this information in a way that doesn’t reveal a User’s personal information (“Market Research”) in order to:
- Market the Service
- Improve the likelihood of a sale to a group of Users
- Increase the likelihood that a group's experience with the Service is relevant to its interests as a whole
Fitnessity uses data at the individual level to sell products and services to Users who express an interest in these products and services, through a poll for example, or to Users who can be presumed to have an interest based on results from our Market Research. Fitnessity may use your email, cell phone number to call or text you in order to provide the Service. We use Financial Information solely as authorized by you in accordance with the Service.

There are Services being offered for children and adults starting from age 2 and up. Fitnessity requires everyone to be at least 13 years old before they can create an account (in some jurisdictions, this age limit may be higher). Parents or Legal Guardians are advised to be present and hands while their child creates an account on the Platform. Parents or Legal Guardians are recommended and advised in educating their child about the dangers of open communication on the Platform and creating boundaries and configuring the settings to keep their child safe and responsible. Creating an account with false info is a violation of our terms. This includes accounts registered on the behalf of someone under 13. If your underage child created an account on Fitnessity, you can show them how to delete their account via settings. If you'd like to report an account belonging to someone under 13, please contact us at firstname.lastname@example.org. Note that we'll promptly delete the account of any child under the age of 13 that's reported to us. If we discover that an individual under 13 has provided us with personal information, we will close the account and delete such information. Please mark your inquiries "COPPA Information Request." Adults 18 and over are only permitted to communicate with a service provider or to book a Service on the Fitnessity Platform. Children and Teens 17 and under are not permitted and are advised not to communicate, book a Service, or meet up with any Service Provider alone or without a parent or legal guardian present. Children are not permitted in traveling or being alone with any Service provider found on the Fitnessity Platform even if a parent or legal guardian permits it. You acknowledge that Fitnessity is not responsible for irresponsibility or abuse of Service of the Platform
We employ appropriate physical, procedural and technological security measures, which are reasonably designed to help protect your personal information from unauthorized access or disclosure. Fitnessity may use encryption, passwords, and physical security measures to help protect your personal information against unauthorized access and disclosure. No security measures, however, are 100% failsafe. Therefore, we do not promise and cannot guarantee, and thus you should not expect, that your personal information or private communications will not be collected, disclosed and/or used by others. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, keeping your log-in and password private, and not recycling passwords from other websites or accounts. Fitnessity is not responsible for the unauthorized use of your information nor for any lost, stolen, compromised passwords, or for any activity on your account via unauthorized password activity.
UPDATING, DELETING, AND CORRECTING YOUR INFORMATION
YOUR CHOICES REGARDING EMAIL COMMUNICATIONS
We may send periodic promotional or informational emails to you. You may opt out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to 14 business days for us to process opt-out requests. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your account or any services you have requested or received from us.

FITNESSITY WILL POST ITS UPDATED POLICY ON THE PLATFORM OR SEND YOU AN EMAIL IN ADVANCE OF THE NEW EFFECTIVE DATE. FITNESSITY ENCOURAGES YOU TO REVIEW THIS POLICY REGULARLY FOR ANY CHANGES. YOUR CONTINUED ACCESS TO OR USE OF THE PLATFORM WILL BE SUBJECT TO THE TERMS OF THE THEN-CURRENT POLICY.
CONSENT TO TRANSFER
Our computer systems are currently based in the United States, so your personal data will be processed by us in the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. If you create an Account with the Platform as a visitor from outside the United States, by using the Platform, you agree to this Policy and you consent to the transfer of all such information to the United States, which may not offer an equivalent level of protection of that required in the European Union or certain other countries, and to the processing of that information as described in this Policy.
